Silaar LLC respects the intellectual-property rights of others and expects our customers to do the same. This policy explains how to raise a trademark or copyright concern and how we respond.
1. Overview
Silaar operates a commerce-data and distribution gateway. We provide infrastructure and a unified API; the underlying product data, listings and content are supplied by, or accessed on behalf of, our customers and third-party sources. If you believe content made available through our Services infringes your rights, contact us using the details in Section 7 and we will act promptly under this policy.
2. Trademarks & No Affiliation
All product names, logos, brands and trademarks referenced anywhere in connection with the Services are the property of their respective owners. Any reference to a third-party marketplace, retailer or brand is for identification and descriptive purposes only (nominative fair use) and does not imply any affiliation with, sponsorship by, endorsement by, or partnership with that party.
Silaar is an independent service and is not affiliated with, authorized by, or endorsed by any third-party marketplace or brand unless expressly stated in a signed written agreement. If you are a rights holder and believe your mark is being used improperly, email legal@silaar.com and we will review and respond.
3. Copyright Complaints (DMCA)
Consistent with the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) and comparable frameworks, we operate a notice-and-takedown process. On receipt of a valid notice, we will expeditiously remove or disable access to the material identified and, where appropriate, notify the customer responsible for it.
4. Filing a Copyright or Trademark Notice
To be actionable, your written notice should include:
- Your name, organization, and contact details (email and, where relevant, address and phone).
- Identification of the copyrighted work or trademark you claim has been infringed (e.g., a registration number or a representative example).
- Identification of the material you claim is infringing, with enough detail for us to locate it (such as the specific API endpoint, resource identifier, or URL).
- A statement that you have a good-faith belief the use is not authorized by the rights holder, its agent, or the law.
- A statement that the information in your notice is accurate, and (for copyright) that under penalty of perjury you are authorized to act on behalf of the rights holder.
- Your physical or electronic signature.
5. Counter-Notification
If your content was removed and you believe it was removed in error or that you have the right to use it, you may submit a counter-notification to the contact in Section 7 identifying the material, your contact details, and a statement, under penalty of perjury, that you have a good-faith belief the removal was a mistake or misidentification.
6. Repeat Infringers
We reserve the right to suspend or terminate, without refund, the accounts of customers who are determined to be repeat infringers or who upload, distribute, or request content they are not authorized to use. Our customers are contractually responsible for holding the rights necessary to the data and content they route through the Services.
7. Designated Contact
Send copyright, trademark, and takedown notices to:
- Email: legal@silaar.com
- Mail: Silaar LLC, 30 N Gould St, Ste R, Sheridan, WY 82801, United States
We aim to acknowledge valid notices within a reasonable time. Submitting a knowingly false notice or counter-notice may expose you to liability for damages, including costs and attorneys’ fees.
